Dismissing these the Magistrate, Mr Geoffrey Raphael, explained that he was ‘unable to find anything (in the Regulations) which prevents a doctor exercising his own discretion and saying, “In my view this man should have this drug” and give it to him’ (Daily Telegraph, 9 September 1955; Criminal Law Review 326, 1956) supporting a similar interpretation that the Regulations did not in any way limit a doctor’s right to prescribe dangerous drugs, which had been given by Counsel in connection with the submission of evidence to the Rolleston Committee some 30 years earlier.

Walker, who had administrative responsibility in the Home Office for drugs policy, and would certainly have been one of the ‘recent developments’ placed before the Committee had he not been transferred to other work before they began their enquiry. Whilst most of the blame for the failure to bring the emergence of this new group to the attention of the Committee must rest with the Home Office, the Committee cannot entirely escape responsibility.
